Travel agencies‟ obligation to provide the guarantees requested by the directive on package travel

In this paper, we consider the content of the Directive (UE) 2015/2302 of the European Parliament and of the Council of 25 November 2015, on package travel and linked travel arrangements, amending Regulation (EC) No 2006/2004 and Directive 2011/83/EU of the European Parliament and of the Council and repealing Council Directive 90/314/EEC.

In particular, the object of study is to consider the effectivity and scope of the protection of the passengers against situations of breach of the obligations resulting from the provision of services, and in particular under insolvency situations, in which travel agencies may incur, both when they are stablished within the territory of the European Union or abroad. To do that, after considering the European regulation, we study the different transpositions that have been made of these legal obligations into the particular regulations of Spanish regions, so as others that are currently under elaboration. The opinion of the relevant undertakings on the obligation to provide such guarantees is also considered.
